Q: Which of my friends are eligible?
A: All of your friends are eligible as long as they're not already ValueBIN.com customers, and have not already been referred by someone else (in the past 12 months).

Q: What happens if I refer a friend who is not eligible?
A: When you refer a friend who is not eligible a message will appear letting you know that the friend you referred is not eligible.

Q: How many friends can I refer?
A: You can refer up to 100 of your friends each year (a maximum of 10 per day). And you can earn a $5 gift certificate to be used with any purchase of $25 or more of ValueBIN.com merchandise for each referral as long as the friends you refer are eligible and redeem their gift certificates. Only one gift certificate may be redeemed per qualifying order.

Q: How can I ensure my friends' privacy?
A: Because we are committed to protecting our customers' privacy (and the privacy of their friends), we will use your friend's e-mail address only for the purposes of this program. If your friends become ValueBIN.com customers they will be covered by our privacy policy. Also, if a friend receives a referral and chooses not to become a customer, he or she will not be eligible to receive another referral e-mail for one year. Finally, when your friends receive the referral e-mail, they will be given the opportunity to remove their e-mail address from the Refer-A-Friend program permanently if they wish.

Q: When will I receive my $5 "thank you"?
A: In most cases you will receive your gift certificate quickly, however, it will depend on each friend's response. Please note that even for successful referrals it may take some time to receive your gift certificate. The reasons for this include: Your friend may not reply to the Refer-A-Friend e-mail immediately. Your friend may not make a purchase at ValueBIN.com right away. We will e-mail your gift certificate to you after your friend's order has been shipped.

Q: Can I submit group e-mail aliases or e-mail mailing lists as referrals?
A: No. The program will reject any group e-mail aliases or mailing-list e-mails, and the Refer-A-Friend e-mail will not be sent out. Please read the terms and conditions for more details.

By participating in the Refer-A-Friend Program (the "Program"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

1. Eligibility. This Program is open only to existing customers of ValueBIN.com and on the following terms and conditions. No purchase is necessary to participate in the Program.

2. Persons Who May Be Referred. You must only refer to ValueBIN.com individuals who you have a personal or business relationship with and who you believe would like to receive a gift certificate from ValueBIN.com (a "Friend"). Without limiting the generality of the foregoing, you must not submit for referral i) group e-mail addresses, ii) e-mail mailing lists, or iii) yourself.

3. Number of Referrals. You may refer up to 100 Friends to ValueBIN.com, but only 10 Friends may be referred per day on the "Refer-A-Friend Start Page." You may refer each Friend only once.

4. Gift Certificates Sent to Friends. ValueBIN.com will, if it determines in its sole discretion that you have complied with these Terms and Conditions, send on your behalf an e-mail to each Friend that you refer toValueBIN.com before the Program closing date which ValueBIN.com may determine from time to time in its sole discretion, so long as that Friend has (a) not already previously purchased products from ValueBIN.com (b) not already been referred to ValueBIN.com by another party; and/or (c) has previously requested that ValueBIN.com not send them any emails. Each e-mail that is sent under this Program will contain a gift certificate with a face value of $5 (or such other amount that ValueBIN.com determines in its sole discretion from time to time), good with any purchase of $25.00 or more of merchandise. Where a Friend is already registered with ValueBIN.com, neither the e-mail nor the gift certificate will be sent to that Friend.

5. Gift Certificates Sent to You. For each of your Friends that qualify for and are sent a gift certificate under this Program and become a new customer of ValueBIN.com, ValueBIN.com will send to you a gift certificate with a face value of $5 (or such other amount that ValueBIN.com determines in its sole discretion from time to time)good with any purchase of $25.00 or more of merchandise. A Friend will only be deemed to have become a new customer for the purposes of these Terms and Conditions at the time that he or she places an order with ValueBIN.com and the product(s) purchased under that order are dispatched by ValueBIN.com. ValueBIN.com will not send a gift certificate to you unless and until it dispatches to that Friend the product(s) purchased under that order. You are entitled to receive up to, but not to exceed, 100 gift certificates per rolling year measured from the date of your first referral.

6. Remedies for Your Noncompliance. If ValueBIN.com determines in its sole discretion that you have not complied with these Terms and Conditions, it may, in addition to any other rights and remedies it may have against you, immediately and without notice to you, withdraw all benefits to you and your Friends under this Program (including, without limitation, by canceling or declining to send any and all gift certificates issued or to be issued to you and to any of your Friends in connection with this Program and, by declining to send or stopping from being sent, any Refer-a-Friend e-mails).

7. Your Consent to Use Your Data in E-Mails. You grant to ValueBIN.com your consent for it to use your name and e-mail address for the purposes of sending an e-mail to your Friends in the form displayed on the e-mail preview page (see the Refer-A-Friend Welcome Page). You agree not to use any false e-mail addresses or names for this program.

8. Your Representations and Warranties to Us. You represent and warrant to ValueBIN.com that you have an existing business or personal relationship with each Friend and that it is your genuine opinion that each Friend would wish to receive a gift certificate from ValueBIN.com. By providing us with the names and email addresses of your Friends, you are affirmatively requesting and authorizing ValueBIN.com to send them an email, as outlined herein, on your behalf.

9. Gift Certificate Terms and Conditions. Each gift certificate issued under this Program is issued subject to the Gift Certificate Terms and Conditions and will, in the case of gift certificates sent to a Friend, expire within ten (10) days of the date that the e-mail containing the gift certificate is sent to that Friend, or on the earliest date permitted under applicable law, whichever occurs later.

10. Limitation of Liability for ValueBIN.com. TO THE FULLEST EXTENT PERMITTED AT LAW, NEITHER VALUEBIN.COM NOR ANY OF ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR OTHER REPRESENTATIVES WILL BE LIABLE FOR DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS PROGRAM. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING (WITHOUT LIMITATION) COMPENSATORY, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, INCOME, OR PROFIT; LOSS OF OR DAMAGE TO PROPERTY; AND CLAIMS OF THIRD PARTIES.

11. Entire Agreement. These Terms and Conditions represent the entire agreement between you and ValueBIN.com with respect to the Program.

12. Variation of the Terms and Conditions. These Terms and Conditions may be amended or modified by ValueBIN.com in its sole discretion at any time. Any such amendments will be posted to this page, and it is your responsibility to review this page from time to time for such amendments.

13. Currency and Times. All amounts stated in these Terms and Conditions are in U.S. dollars, and times and dates are based on Central Standard Time.

14. Severance. If any provision of these Terms and Conditions is held to be invalid, such invalidity will not affect the remaining provisions.

15. Governing Law. These Terms and Conditions will be interpreted, construed, and enforced in all respects in accordance with the laws of the State of Texas, without giving effect to any principles of conflicts of laws. You hereby irrevocably consent and submit to the nonexclusive personal jurisdiction of the state and federal courts within Harris County, Texas for the purposes of litigating any such action.
